The Court of Justice of the European Union (CJEU) lies at the heart of European integration. Its rulings have considerable political repercussions. CJEU scholarship examined the Court’s impact on integration and policy-making, the opportunities it affords to various actors, and its independence from member states; but it largely neglected the appointment of CJEU judges and their policy preferences. The project analyses appointments as expressions of a principal agent or trustee relationship between Court and member states.

Surveys regularly indicate that the level of knowledge about the European Union is rather low in the general population. This is particularly true for lesser known EU institutions like the EU agencies, which have, notwithstanding, significantly gained in number and importance over the last 15 years. Despite a multitude of research papers on individual agencies in the pertinent scientific literature, little is known about the cooperation between these agencies. EU Foreign Policy Facing New Realities

EU foreign policy experiences unprecedented turbulences that put key achievements of the European integration project at risk. Externally, the EU’s global environment is characterized by the reconfiguration of power, growing divisions, and the contestation of established liberal order. Together with Jorgen Wettestad (Fridtjof Nansen Institute, Oslo) and Katja Biedenkopf (University of Leuven), Patrick Müller and Peter Slominski organise an international workshop on “Global experimentalism and policy innovation in greenhouse gas emissions trading” that will take place at the University of Leuven, Belgium on 8-9 February 2016. The workshop will bring a mix of high-ranking academics and practitioners to discuss the global spread of emissions trading. It was selected after a competitive process and will be funded by COST.

EUROSPHERE is a European Commission-funded Integrated Project within the 6th Framework Programme. The EUROSPHERE Consortium comprises 17 European universities and research institutes and approximately 150 researchers work in the project's different parts and phases. The project is coordinated by the University of Bergen.
The overall objective of EUROSPHERE is to develop innovative perspectives on the European Public Sphere and to identify the factors which facilitate or hinder the articulation of a European Public Sphere. The research plan comprises synchronized data collection and analysis activities in 16 countries as well as creation of a Eurosphere Knowledge Base.
In addition to regular research and academic dissemination activities, EUROSPHERE organizes several large-scale conferences, European Forums, researcher training and PhD courses.
The main objective of EUROSPHERE is to create innovative perspectives on the European Public Sphere and to identify the conditions that enable or undermine the articulation of an inclusive European Public Sphere. Towards this objective,

In dieser Arbeit von Gerd Valchars soll die Unionsbürgerschaft unabhängig von ihrem völkerrechtlichen Gehalt auf ihre (potentielle) soziale und politische Funktion untersucht werden. Die Unionsbürgerschaft wird scheinbar als identitätsstiftende Ressource betrachtet, die dazu beitragen soll, Solidarität zwischen den Bürgerinnen und Bürgern zu erzeugen und das vielfach eingeforderte Europabewusstsein und eine sog. europäische Identität, kritisch oftmals auch als Europa- Patriotismus oder -Nationalismus bezeichnet, zu fördern. Es soll eine Annäherung an diese zum Teil höchst umstrittenen politischen Schlagworte erfolgen und die Frage aufgeworfen werden, wie viel "Identität" der Bürgerinnen und Bürger in einem sich politisch vereinenden Europa tatsächlich notwendig ist und wie eine soziale Integration Europas und die Ausbildung von innergesellschaftlicher und transnationaler Solidarität ohne Zuhilfenahme überkommener nationalstaatlicher Konzepte erreicht werden können. Dazu soll der Fokus der Betrachtung auf die Unionsbürgerschaft gelegt werden, die gegenüber dem Rechtsinstitut der Staatsbürgerschaft, wie es die Mitgliedstaaten kennen, einige konzeptuelle Defizite aufweist.

TIES / The Integration of the European Second Generation

The international research project TIES focuses on "second generation" migrants in eight European countries, referring to those descendants of immigrants from Turkey, Ex-Yugoslavia, Morocco, and Greece, who were actually born in the country.

TIES studies the topic of integration, be it economic, social, educational, or in terms of identity. TIES is looking at the long-term consequences of large-scale labour migration from the 1960s onwards. Since little internationally
comparable statistical material on the second generation is available, the main objective is to create the first systematic and rigorous European dataset. The data of more than 10,000 respondents in fifteen European cities will be relevant not only for a better general understanding, but also for the development of policies at all levels of government. The results will be discussed at local, national and international level with a broad forum of scientists, policy makers, and civil society activists. The TIES project is funded by a diverse range of funding sources, among others the German Volkswagen-Stiftung, national science foundations (through the programme "European Collaborative Research Projects in the Social Sciences" of the European Science Foundation), the Swiss foundation "Stiftung Bevölkerung, Migration und Umwelt" (BMU), and the researchers’ home institutions and universities.

The Austrian part is mainly funded by the national science foundation FWF "Fonds zur Förderung der wissenschaftlichen Forschung" through the above mentioned ESF-Programme.

The workshop was organised by EIF, the Institute for European Integration Research of the Austrian Academy of Sciences, together with eipcp, european institute for progressive cultural policies. Its main question was the relevance of artistic interventions for the creation of a critical European public sphere.

Starting points of the debates were basal considerations on the role of the public sphere in democracies: Political agency does not constitute of neutral state management but of contestations for power and resources. Political agency becomes public due to controversial debates on its principles and aims. Artistic institutions and individual artists can contribute to such debates and, thus, to a political public sphere.

Against this background concrete artistic practices of political intervention were discussed. Thereby, two kinds of projects were of special interest with regard to the European public sphere, (1) transnational networks and projects, and (2) projects devoted to questions of European identity and history. A prominent example for the first group of projects is the Mayday movement representing the interests of persons without sufficient social security, i.e. people in precarious living and working conditions. Other transnational projects presented during the workshop take a critical position towards EU education politics. With regard to the second type of projects, the film group “remember resistance” presents commented film programs of African directors, on the history of German colonialism, on de-colonization and on migration movements.

Debates focused on two main questions:
1. Do the presented projects, in fact, contribute to the development of public spheres or are they only perceived by people already acquainted with the questions at hand?
2. In which ways do the projects contribute to a European Public Sphere?

The workshop participants agreed that - empirically as well as normatively – the European public sphere can only be understood in the plural, i.e. as partial, partly overlapping public spheres, organised according to local or functional criteria. Thus, also very limited public spheres have to be understood as part of a European public sphere. The presented networks dealing with precarity and education are good examples for transnational public spheres contributing to a specific form of Europeanisation: Their debates of EU developments help to distribute information relevant to the EU and to develop critical positions with a European perspective.

LEITUNG: Dr. Jozef Bátora

Zwischenstaatliche Beziehungen werden traditionell über diplomatische Kanäle betrieben. Bilaterale Botschaften spielen dabei als Träger der Kommunikation und Repräsentation eine zentrale Rolle. Die formellen Regeln, die die Arbeit der bilateralen Vertretungen heute bestimmen, wurden durch den Wiener Kongress 1815 und später durch die Wiener Konvention von 1961 formalisiert; Wien spielte somit eine entscheidende Rolle in der Entwicklung der modernen Diplomatie. Im Prozess der europäischen Integration werden etablierte Prämissen für diplomatische Beziehungen vor neue Herausforderungen gestellt. In einer politisch, ökonomisch und administrativ so hoch integrierten Region wie der heutigen EU, in der die meisten Kontakte zwischen den Mitgliedsstaaten ausserhalb der offiziellen diplomatischen Kanäle stattfinden, ist die raison d’être bilateraler Botschaften fraglich geworden. Bisherige wissenschaftliche Studien berührten diese Problematik nur marginal, brachten sehr unterschiedliche Erkenntnisse und verblieben meist auf abstraktem Niveau. Empirisch belegte Arbeiten zur Dynamik des Wandels in der Organisation und Arbeitsweise der innereuropäischen Diplomatie fehlen bislang in der wissenschaftlichen Literatur. Vor diesem Hintergrund war das Ziel der Diskussion am Runden Tisch, erste empirische Indikatoren zum Wandel, bzw. zur Stabilität der Strukturen und Funktionen der Botschaften der EU Mitgliedsländer innerhalb der EU zu entwickeln. Die Relevanz Wiens für eine derartige Untersuchung ist nicht nur durch die vergleichsweise hohe Anzahl an diplomatischen Vertretungen aus der ganzen Welt in dieser Stadt gegeben, sondern birgt in sich auch einen gewissen symbolischen Wert, bestimmt durch die historische Rolle der Stadt in der Entwicklung und Formalisierung der modernen Diplomatie.

Die Veranstaltung bestand aus zwei Teilen. Am Vormittag fand ein akademisches Seminar statt, im Rahmen dessen die Teilnehmer - Dr. Jozef Bátora (EIF, ÖAW), Ges. Gerhard Reiweger (Diplomatische Akademie Wien), Prof. Brian Hocking (Loughborough University, UK), Prof. Morten Egeberg (ARENA – Centre for European Studies, Universität Oslo), David Rijks (University of Cambridge) und David Spence (Europäische Kommission, DG Relex) – theoretische Grundlagen, Forschungsfragen, Hypothesen und Methoden diskutierten, die für die Erforschung des Wandels der Intra-EU Diplomatie von Relevanz sind.

Am Nachmittag folgte dann eine Diskussion am Runden Tisch mit Vertretern der in Wien akkreditierten bilateralen Botschaften von Dänemark, Frankreich, Großbritannien, Lettland, Niederlande, Portugal, Rumänien, Slowenien, Ungarn und Zypern. Die Diskussion wurde vom Direktor der Diplomatischen Akademie Wien, Bot. Jiri Gruša, eröffnet. Daraufhin folgten kurze Impulsreferate von Dr. Jozef Bátora, Bot. Ferdinand Trauttmannsdorf (BMeiA, Wien) und David Spence. Aus den Diskussionsbeiträgen der Diplomaten ließen sich drei interessante Entwicklungstendenzen ableiten.
1) Obwohl traditionelle bilaterale Agenden immer noch eine gewisse Rolle spielen, fokussieren 80-95% der politischen Arbeit der Botschaften auf Fragen, die im Rahmen des COREPER verhandelt werden. Die bilateralen Botschaften der EU Mitgliedsländer in Wien dienen daher in erster Linie der Vorbereitung von Verhandlungsprozessen in Brüssel.
2) Die meisten Botschaften sind von den heimischen Regierungen aufgefordert worden, Experten aus verschiedenen Bereichen der Verwaltung zu beschäftigen, um für spezifische Fragen Expertise vor Ort zu schaffen. Die Botschaften werden dadurch „entdiplomatisiert“.
3) Aufgrund von finanziellem Druck und von Sparmaßnahmen wird diplomatisches Personal in fast allen EU-Ländern reduziert. Einige Länder haben nunmehr „Laptop-Botschaften“ in Wien, sodass sich nicht mehr als ein bis zwei Diplomaten in Wien aufhalten. Dies führt dazu, dass die meisten Agenden der Beziehungen zu Österreich von den Regierungsorganen in den jeweiligen EU-Ländern direkt verwaltet werden. Die bilateralen Botschaften in Wien werden dadurch zu relativ teuren, aus öffentlichen Mitteln finanzierten „Reisebüros“, die die Aufenthalte der Regierungsmitglieder organisieren, die zu Arbeitstreffen nach Wien kommen.
Die Diskussion am Runden Tisch lieferte zahlreiche interessante Ansatzpunkte für weitere Forschungsprojekte. Unter anderem wird das EIF, ÖAW im ersten Halbjahr 2008 follow-up Interviews in einigen Botschaften der EU Mitgliedsländer in Wien durchführen, um die Erkenntnisse der Diskussion zu vertiefen. Diese Recherchen dienen als empirische Grundlage für einen oder mehrere wissenschaftliche Artikel.

International migration, into and within the EU, is a fundamental issue of politics and policy today. It is set to remain so for years to come, for reasons that lie both inside and outside Europe. This will have far-reaching consequences for the member states and for the EU as a whole -- how to manage demand and supply-driven migration, how to integrate the resident immigrants, how to adapt institutional arrangements to preserve social cohesion? To provide comprehensive theoretical and empirical knowledge that can form a reliable basis for policy, 19 established European research institutes have established a Network of Excellence in the domain of International Migration, Integration and Social Cohesion (IMISCOE). The Network brings together some 300 selected, highly qualified researchers. Based on their wide-ranging skills and experience in international comparative research, the institutes implement an integrated, multidisciplinary, rigorously comparative research programme, with Europe as its central focus.

The project will provide a comprehensive comparison of rules regulating the acquisition and loss of nationality in the EU Member States. This will be achieved by collecting information about current legislation and the development of nationality law since the 1980s, by analysing statistical data on naturalization, acquisition of nationality at birth, and loss or renunciation of nationality, and by investigating administrative practices in the implementation of nationality laws. The project will also examine statuses of quasi-citizenship for third country nationals that are granted in several Member States on the basis of long-term residence or to nationals of certain countries or ethnic background. Apart from providing country reports on these questions the project’s main goal is to develop a systematic frame for comparing specific aspects in the regulation of nationality and citizenship across countries. The goal is to find out in which areas there are trends of long-term convergence or persistent divergence between Member States. This will serve as the basis for a broad evaluation of Member States policies in this area and for policy recommendations addressed to both Member State governments and the EU. The main focus for the evaluative part will be on the question how access to citizenship and nationality contributes to the integration of immigrants. Theorien zur Europäischen Öffentlichkeit sind oft von normativ sehr anspruchsvollen Erwartungen an nationale Öffentlichkeiten geprägt. Nationale Öffentlichkeiten müssen aber realiter nicht immer dem Bild der relativen Homogenität entsprechen und können so auf die Herausbildung von Europäischen Öffentlichkeiten einwirken. Ausgehend vom Diskursbegriff der radikalen Demokratie wird in diesem Paper davon ausgegangen, dass zur Bedingung der Ermöglichung einer Europäischen Öffentlichkeit (ob nun im Plural oder Singular), bereits auf der Ebene darunter, i.e. der nationalen, die allein schon infrastrukturell die ausschlaggebende ist, gewisse gemeinsame Diskursstrukturen und Bedeutungszuschreibungen vorhanden sein müssen. Daher wurden exemplarisch, zur Erfassung der heterogenen und homogenen Dimensionalität nationaler Öffentlichkeiten, mediale österreichische Debatten zu den Wahlen zum Europäischen Parlament 2004 für eine Analyse herangezogen. Die empirische Studie analysiert alle zum Thema Europawahlen erschienen Artikel vom 01.04.-20.06.2004 in vier österreichischen Tageszeitungen (Krone, Kurier, Presse, Standard). Dafür wurde auf Grundlage der radikalen Demokratie- und Hegemonietheorie von Ernesto Laclau und Chantal Mouffe ein Analyseschema entwickelt.

Im Rahmen dieses Projektes erfolgt eine komparative Analyse und Aufarbeitung der derzeitigen politischen und wissenschaftlichen Debatte über eine mögliche Europäische Verfassung. Dabei sollen juristische und politische Traditionen sowie die bestimmenden Termini der Debatte auf ihre Tragfähigkeit überprüft werden. Ausgangspunkt des Projektes ist die Prämisse, daß die Dominanz der Exekutiven im Verbund von nationalem und europäischem Policy-making zu einer Erosion von repräsentativer Demokratie führt. Dies kann zu ernsten Problemen für die Legitimität und damit auch Kontinuität des europäischen Integrationsprojektes werden. Im Zentrum des Projektes steht die Frage, welches Polity-Modell den angemessenen repräsentativ-demokratischen institutionellen Rahmen für die Europäische Union bilden kann. Dazu werden neben klassischen Verfassungsmodellen (USA, Kanada, Frankreich, Deutschland, Großbritannien) auch gegenwärtige Konzepte untersucht.

Das Projekt diente der Analyse aktuell diskutierter europäischer Verfassungsmodelle. Im Rahmen dieser Untersuchung wurden institutionelle Strukturen der Europäischen Union mit der Forderung nach dem Aufbau einer europäisierten Öffentlichkeit in Zusammenhang gebracht. Ein Hauptanliegen des vorliegenden Projektes bestand in der Beschreibung und Analyse der Verschränkung von nationalem und europäischem policy-making als Voraussetzung für das Anbieten von Politiklösungsoptionen.

Die nationalen Parlamente üben bereits im derzeitigen Institutionengefüge eine bedeutende Legitimierungsfunktion aus, namentlich durch die Ratifikation der Verträge, die Umsetzung von Richtlinienrecht und die Kontrolle der nationalen Regierung. Letzteres wurde in der vorliegenden Studie in fünf Mitgliedstaaten (Belgien, Deutschland, Frankreich, Großbritannien und Österreich) untersucht. Die Ergebnisse widersprechen mit einer Ausnahme der Erwartung, dass Parlamente "ihre" Regierungen tatsächlich kontrollieren können. Die formal sehr weitgehenden Rechte der Parlamente in Deutschland und Österreich werden in der Praxis wenig intensiv genutzt und dienen eher der Aufrechterhaltung einer parlamentarischen Option für "worst case" Situationen; nicht die tagtägliche Ausreizung der parlamentarischen Beteiligungsrechte steht hier im Mittelpunkt des Interesses, sondern die Pflege von Kontrollansprüchen gegenüber den Regierungen mit dem Ziel, diese für den Fall einer "echten", mithin konflikthaft verlaufenden Mitwirkung des Parlaments rasch aktivieren und effektiv nutzen zu können. Im britischen Unterhaus werden die Berichte der Regierung eher kommentiert als kontrolliert. Die eigentliche politische Kontrolle der Regierung findet durch das Oberhaus in der Form umfassender Berichte statt. In Frankreich sind die Kontrollrechte des Parlamentes aus historischen und strukturellen Gründen besonders schwach ausgeprägt. Lediglich in Dänemark kann man tatsächlich von starken parlamentarischen Mitwirkungsrechten sprechen. Der Grund liegt sowohl in der dänischen Tradition von Minderheitsregierungen als auch in der verfassungsrechtlich abgesicherten starken Position parlamentarischer Minderheiten.

Ein Grund für die bescheidene Inanspruchnahme der bereits existierenden Mitwirkungs- und Kontrollrechte durch die nationalen Parlamente liegt in einem unzureichend ausgeprägten europapolitischen Bewusstsein der einzelnen Abgeordneten. Ein Weg, dieses zu erhöhen, wäre ein kontinuierlicher und nachhaltiger Meinungs- und Informationsaustausch mit Parlamentariern anderer Länder und den supranationalen Organen. Erste Ansatzpunkte dafür bietet die COSAC – diesbezügliche Anstrengungen wären zu intensivieren. Darüber hinaus ist allerdings auf nationaler Ebene eine ausreichende personelle und finanzielle Ressourcenausstattung der Parlamente zu gewährleisten.

In einem weiteren Schritt wurde untersucht, welche Rolle den nationalen Parlamenten wie auch den anderen Institutionen des europäischen Mehrebenensystems, namentlich dem Europäischen Rat, dem Rat der Europäischen Union, der Europäischen Kommission sowie dem EP in einer künftigen Neuordnung der EU von PolitikerInnen zugedacht werden. Dabei wurden die Debattenbeiträge europäischer Staats- und Regierungschefs zur Zukunft Europas in institutioneller Hinsicht systematisiert und demokratiepolitisch bewertet. Die Ergebnisse sind schwer auf einen gemeinsamen Nenner zu bringen. Zu unsystematisch und heterogen sind die Vorschläge. In keiner Rede wird ein vollständiges und kohärentes Verfassungsmodell entwickelt. Vielmehr werden Vorschläge für einzelne Institutionen ausgesprochen, die jedoch selbst wiederum viele Fragen aufwerfen. Entsprechend den normativen Prämissen der Europäisierung von Politik und der Demokratisierung der EU werden sämtliche Vorschläge, die auf eine Stärkung des Europäischen Rates und des Rates der Europäischen Union auf Kosten des EP hinausliefen, negativ bewertet. Konkret sprechen sich die AutorInnen für eine weitere Ausdehnung der Kodezisionsrechte des Europäischen Parlamentes, für die Ausdehnung der qualifizierten Mehrheitsentscheidung im Rat und für die Wahl des Kommissionspräsidenten durch das EP aus. Überdies wird die Aufnahme der Charta der Grundrechte in den Rechtsbestand der EU befürwortet.

Um eine möglichst breite politische und gesellschaftliche Basis zu gewährleisten, wird im vorliegenden Bericht die Einrichtung eines Konventes befürwortet, der sich sowohl aus nationalen und supranationalen Parlamentariern als auch aus Regierungsvertretern und Repräsentanten der Europäischen Kommission zusammensetzen soll. Zusätzlich wäre auch ein, diesen Konvent begleitendes Forum aus VertreterInnen der Zivilgesellschaft wünschenswert, die in einem ständigen Austausch mit den Konventsmitgliedern stehen, um eine solche breite Basis zu garantieren.

Legislative und Exekutive

In ausgewählten Rechtsgebieten wie dem Telekommunikationsrecht, dem Berufszugangs-, dem Umwelt- und dem Steuerrecht werden derzeit umfassende Erhebungen hinsichtlich des Rechtsentstehungsprozesses und der Umsetzung von Verordnungen, Richtlinien, Entscheidungen und Empfehlungen durchgeführt. Dabei geht es zunächst um die rechtsdogmatische Aufarbeitung der relevanten Rechtsakte und in einem zweiten Schritt um die Analyse der politischen und ökonomischen Akteure und deren Interessen, die für die Implementierung bedeutsam sind. Eine Publikation der Ergebnisse erfolgt in der von Michael Schweitzer und Sonja Puntscher Riekmann herausgegebenen Serie „Institutioneller Wandel und europäische Integration“bei Manz, Wien.

Telekommunikationsrecht: Das Forschungsprojekt Implementierung des EG-Rechts in Österreich wurde mit einer Studie über die Umsetzung des Telekommunikationsrechts begonnen und im Jahre 2001 abgeschlossen. Sie zeigte, daß diese Umsetzung trotz der erheblichen institutionellen Neuerungen, die damit einhergehen mußten relativ erfolgreich verlief. Dabei hatten Exekutive und Legislative sich wesentlich an die deutsche Umsetzungspraxis angelehnt. Dennoch konnten Fristüberschreitungen nicht vermieden werden. Die Forschungsthese des Werks hinsichtlich des Primates der Exekutive gegenüber der Legislative konnte weitgehend bestätigt werden, wenngleich es auch auf seitens der Bürokratie erheblichen Adaptationsbedarf im Zuge der Implementation des Gemeinschaftsrechts gab.

Judikative

In diesem Projektteil liegt der Schwerpunkt in einer Untersuchung der Übereinstimmung österreichischen Rechts mit Gemeinschaftsrecht und der Auswirkungen, die letzteres auf die auf die Gerichtsbarkeit hat. Höchstgerichtliche Urteile, die Gemeinschaftsrecht berühren, wurden auf a) die Einhaltung der Pflicht der Gerichte, eine Vorlage an den EuGH heranzutragen und b) die Erfüllung der Pflicht zur Anwendung des Gemeinschaftsrechts hin geprüft. Unzulänglichkeiten bei der Anwendung des Gemeinschaftsrechts wurden kategorisiert. Erstmals wurde ein Mängelkatalog erstellt, der den Rechtsanwender für potentielle Fehlerquellen sensibilisieren und in Zukunft zur Fehlervermeidung bei der Anwendung von Gemeinschaftsrecht beitragen soll. Die umfassende Darstellung und Bewertung der Judikatur vom Verfassungsgerichtshof, Verwaltungsgerichtshof und Oberstem Gerichtshof werden durch eine Übersicht aller österreichischen Vorabentscheidungsverfahren und – soweit ergangen – deren Folgeentscheidungen ergänzt. Die Sammlung umfasst Erkenntnisse, Urteile und Beschlüsse aus den ersten sieben Jahren österreichischer Mitgliedschaft in der EU. Sie sollen auch in ausgewählten Kandidatenländern vorgestellt werden, um im Rahmen der Beitrittsvorbereitung genutzt und entsprechend dem jeweiligen nationalen Recht weiterentwickelt zu werden.

Die Egebnisse wurden in verschiedenen Stadien des Projektes mit Rechtsanwendern in folgenden Veranstaltungen diskutiert:

The project on the European Public Sphere was elaborated by the Institute in cooperation with the University of Salzburg and financed by the Austrian Federal Ministry for Education, Science and Culture (bm:bwk). We analyzed debates around the adoption of the European Constitution. One of the main research questions was: How do these debates contribute to the emergence of a European public sphere and thereby to the development of a European democracy? This question was addressed by analysing media coverage of the adoption process and, especially, of the referenda on the European Constitution. The empirical analysis is based on the theory of radical democracy; thus the project also aimed at bridging the gap between normative-theoretical considerations on the European Public Sphere and empirical work on this theme.

The analysis encompasses print media coverage of the process of constitutionalisation in the period from the IGC 2004 to September 2005 in (online available) quality and yellow press (one quality paper and one yellow press paper in each country of the sample). Furthermore, small independent media were included in the analysis where available.

The reform of EC Competition Law entered into force on the day of EU-Enlargement. In a comparative project law scholars will analyse the implementation and application of Regulation 1/2003 by courts in A, CZ, H, PL and SI during the first year after its entering into force. All cases being pending or decided at the courts will be scrutinised and evaluated as to their conformity with decisions of the European Commission, the Court of First Instance and the European Court of Justice and collected in a database.

Regulation 1/2003 aims at an effective and uniform application of Communitarian Competition law, confers new competences on national courts regarding the application of art 81 (et seq) – in particular the application of art 81 (3) EC where we perceive a paradigmatic change of the current centralized system being replaced on 1.5.2004 by a decentralised directly applicable exception system – and sets up new modes of co-operation (Networks) between national authorities and courts and the European Commission. In the very near future it is therefore merely in the hands of national judges to safeguard the directly applicable rights deriving from the Communitarian legal order in the field of Competition law.

It is essential to show up the new challenges for national judges and to systematically elaborate guidelines on the application of EC Competition rules by compiling, analysing and comparing national case-law. The findings will be discussed and compared with the results in the other countries participating in the research in order to set up guidelines for the national courts dealing with Competition Law which will then be published in English. The guidelines will be complemented by extracts of some landmark decisions of the European Commission, the Court of First Instance and the ECJ translated into Czech, Hungarian, Polish and Slovene and distributed to the national judges dealing with Competition law. It is of utmost importance for the national judges to have the European reference cases available in their mother tongue. This part of the project will serve as the basis for further training of national judges. The research partners will nominate English speaking judges in the New Member States who will be invited to the Seminar in Vienna (2.-4.6.2005) in order to present and discuss the outcome of the empirical studies and to equip them with commented case-studies that will henceforth facilitate their practice. The project partners will organize one seminar each for the Competition Law judges of their respective country in order to provide a bigger number of Competition Law-judges with essential information on the application of the Regulation 1/2003 as well as the case-law and the results of their study drawing their attention to potential mistakes that might occur and giving them an orientation as to how to prevent potential deficits. On these occasions the national judges will obtain the guidelines on the application of Regulation 1/2003 in their mother tongue. Furthermore, a homepage will be created and up-dated from where the data can be loaded down free of charge in Czech, German, Hungarian, Polish and Slovene.

Besonderes Augenmerk wird auf die Positionen der jeweiligen Regierungen, politischen Parteien und der relevanten politischen Institutionen (z.B. des militärischen Bereichs) gelegt.

Der Konvent zur Zukunft Europas hat Mitte letzten Jahres seinen abschließenden Entwurf für einen Vertrag über eine Verfassung für Europa vorgelegt. Seit diesem Zeitpunkt liegt ist es an den alten und zukünftigen/neuen Mitgliedstaaten selbst, zu welchem Ausmaß, in welcher Form und ob überhaupt, dieser Entwurf zur tatsächlichen Verfassung der Europäischen Union mit (zunächst) 25 Mitgliedern wird.

Im Mittelpunkt des Projektes steht die Frage nach den realpolitischen Konsequenzen der (neuen) Möglichkeiten der flexiblen Integration im Bereich der Gemeinsamen Außen- und Sicherheitspolitik (GASP), einschließlich der Europäischen Sicherheits- und Verteidigungspolitik (ESVP), wie sie im Verfassungsentwurf des Konvents vorgesehen sind. Besonderes Augenmerk wird auf die Positionen der jeweiligen Regierungen, politischen Parteien und der relevanten politischen Institutionen (z.B. des militärischen Bereichs) gelegt. Der Außen-, Sicherheits- und Verteidigungspolitik kommt auf Grund ihrer überragenden Bedeutung für die Konzepte von Staatlichkeit und wegen der Involvierung „vitaler“ Interessen der Nationalstaaten besondere Relevanz zu. Es kann angenommen werden, dass angesichts der Parallelität von Vertiefung und Erweiterung die Relevanz der flexiblen Integration im Bereich der GASP/ESVP zumindest mittelfristig gegeben sein wird. Die bisher geringe Integration in diesem Politikfeld und die untergeordnete Rolle der supranationalen Institutionen belassen den Mitgliedstaaten relativ große Spielräume. Methodisch baut dieses Projekt auf einer Befragung internationaler ExpertInnen aus politiknahen Institutionen in 15 EU-Mitgliedsstaaten bzw. Kandidatenländern zum Thema „Flexible Integration in der Europäischen Union“ auf.

Ziel des Projektes:
Im Rahmen der Kooperationsabkommen der ÖAW mit ihren Partnerinstitutionen in Bulgarien, Polen, Rumänien, der Slowakei, Slowenien, der Tschechischen Republik und Ungarn werden seit 2003 Fragen der Implementierung und Anwendung des Europarechts analysiert.
Dabei wurde bereits der Beitrittsvorbereitungsprozess und die Anwendung der Europaabkommen, die die EG und ihre Mitgliedstaaten mit diesen Ländern Mittel- und Osteuropas geschlossen haben untersucht.
Im Zentrum des Forschungsinteresses steht die Tätigkeit der Judikative, insbesondere der Höchstgerichte.
Die Europäische Kommission unterstützt dieses Vorhaben im Rahmen von PHARE.

Dies ermöglichte die Durchführung folgender Veranstaltungen:

“National Judges as Judges of EC law” Judges of Constitutional, Administrative and Supreme Courts and scholars from the Czech Republic, Hungary, Poland, Slovakia and Slovenia gathered in order to discuss and assess the first year of applying EC law. Their Austrian colleagues reported on their experience in enforcing EC law. Specific changes of the national legal system due to its interplay with the supranational legal order will be identified. The cases reported will be commented, compiled, translated and disseminated in courts, training and documentation centres in the respective official language of the new Member States in the form of eif-working papers and CDs. Thereby the data on commented cases dealing with EC law and questions referred for a preliminary ruling will be accessible to law applicants in these new Member States.

Das Projekt ist um die Übersetzung des Mengerschen Textes "Geld" im Handwörterbuch für Staatswissenschaften (1892) strukturiert. Darin präsentiert er seine sehr ausführliche Darstellung seiner institutionalistischen Theorie Geldentstehung. Die institutionalistische Methode wird von ihm auch in seinen Hauptwerken "Die Grundsätze der Volkswirtschaftslehre" (1871) und "Untersuchungen über die Methoden der Socialwissenschaften und der Politische Oekonomie insbesondere" (1884) kurz dargestellt, aber nicht in derselben Ausführlichkeit. Da der Text "Geld" sowohl auf die neoklassische Geldentstehungstheorie als auf den Neuen Institutionalismus großen Einfluß hatte, überrascht es, daß er nie ins Englische übersetzt wurde - lediglich ein kurzer Auszug erschien 1892 im Economic Journal. Es ist daher eines der zentralen Ziele dieses Projektes, den gesamten Text der internationalen Wissenschaftlergemeinschaft zugänglich zu machen. Ein weiteres Ziel besteht darin, die Mengersche Methode auf die Analyse der Entstehung moderner Finanzsysteme und der Entwicklung neuer, elektronischer Zahlungssysteme anzuwenden. Um die Übersetzung des Mengerschen Textes werden daher folgende Aufsätze gruppiert werden:

The project launched by the Czech Academy of Sciences builds on the results of the ASO-2006 project, in which a comparative empirical analysis presented the first experiences of the Constitutional courts of the Czech Republic, Hungary and Austria with regard to EC law. The follow-up project of 2007 aims at an update of the empirical data and intends to discuss the recent developments of the constitutional jurisprudence and identify potential friction zones between the supranational and domestic constitutional spheres. In this context, the question will be addressed as to how state theories are gradually modified by the Europeanisation process.

In diesem Projektes wurde ein theoretischer Rahmen erarbeitet, um den institutionellen Wandel von Demokratie adäquat erfassen zu können. Als Analyseobjekt dienten politische Parteien, die aufgrund des fortschreitenden europäischen Integrationsprozesses einer Transformation unterliegen, wodurch die Grundprinzipien liberal-demokratischer Systeme qualitativ verändert werden. Das Projekt verfolgte folgende methodologische Ziele: Zum einen die Entwicklung eines konsistenten Rahmens zur Analyse und Interpretation des europäischen Demokratiedefizites und zum anderen die Eröffnung einer theoretisch-methodologischen Debatte über das Problem der Messung von institutionellem Wandel. Um zu klären, wie das Entstehen des neuen politischen Systems EU politische Parteien und folglich das institutionelle Arrangement Demokratie auf nationaler Ebene beeinflußt, wurden Institutionentheorie und Policy-Analyse miteinander verknüpft.

Den Abschluss des Projektes bildete ein Pre-Test für PolitikerInneninterviews, in dessen Rahmen Interviews mit Nationalratsabgeordneten, Abgeordneten des Europäischen Parlaments und internen MitarbeiterInnen von im österreichischen Nationalrat vertretenen Parteien durchgeführt wurden. Die methodische Grundannahme des Projektes war, dass ein differenziertes Bild der Europäisierung nationaler Parteien nur durch die Analyse konkreter Policies zu gewinnen ist. Dies wurde durch die Projektergebnisse bestätigt. Denn es wurde deutlich, dass es auch Befürwortern der europäischen Integration zum Teil an der Gestaltungsbereitschaft mangelt, die zur Implementierungvon EU-Politiken im nationalen Rahmen nötig wäre. Dies gilt insbesondere für die nationale Legislative und für die nationalen Parteistrukturen; die Abgeordneten zum Europäischen Parlament zeigten sich ebenso wie (ehemalige) Regierungsmitglieder sehr viel informierter und interessierter an europäischen Angelegenheiten als Abgeordnete zum Nationalrat. Dies hat Konsequenzen für die im Protokoll zum Vertrag von Nizza anvisierte Aufwertung der nationalen Parlamente im europäischen Institutionengefüge.

Das gesamtwirtschaftliche Zahlungssystem ist gegenwärtig sowohl in der EURO-Zone als auch in Großbritannien und den USA starkem institutionellen Wandel unterworfen. (1.) Der erste Abschnitt dieses Projektes bietet eine kritische Literaturstudie zu den Auswirkungen des eGeldes auf die Geldpolitik mit besonderem Augenmerk auf die Modellierung des Geldmarktes in den jeweiligen eGeld-Modellen sowie auf die Rolle der Recheneinheitsfunktion des Geldes. (2.) Der zweite Abschnitt widmet sich der komparativen, empirischen Analyse der institutionellen Charakteristika elektronischer Geldsysteme in der EURO-Zone, Großbritannien und den USA. Wir ergänzen die empirischen Arbeiten zu elektronischem Geld durch eine wirtschaftshistorische, empirische Analyse des institutionellen Wandels im Interbanken-Zahlungsverkehr in den USA und die Auswirkungen auf die Geldpolitik. Zudem modellieren wir den Zusammenhang zwischen dem institutionellen Wandel des gesamtwirtschaftlichen Zahlungssystems, dem Geldmarkt und der Geldpolitik. (3.) Der dritte Abschnitt analysiert alternative geldpolitische Instrumente und deren politisch-ökonomische Konsequenzen für die Unabhängigkeit der Zentralbanken für ein hypothetisches Szenario, in dem Zentralbankgeld nicht mehr länger als allgemeines Tauschmittel und Recheneinheit fungiert.

Für die allseits angestrebte Informationsgesellschaft zeichnet sich ein grundlegend verändertes gesellschaftliches Kommunikationssystem ab, das als Mediamatik (Media, Telematik) bezeichnet wird (vgl. Latzer 1997). Sie ist das Produkt aus einer Kombination der technisch- ökonomischen und politischen Trends der Digitalisierung, Liberalisierung, Konvergenz und Globalisierung im Kommunikationssektor. Mit dem neuen gesellschaftlichen Kommunikationssystem kommt es auch zu Veränderungen in der Wirtschaft, die mit dem Begriff der Digitalen Ökonomie charakterisiert werden können.

Ziel des Forschungsprojektes ist es, die Mediamatik und die Digitale Ökonomie mit ihren Charakteristika zu erfassen und den sich ergebenden politischen Reformdruck sowie die notwendigen Reformschritte zu analysieren. Insbesondere sollen der institutionelle Wandel in Richtung Mediamatikpolitik untersucht und adäquate institutionelle Rahmenbedingungen für die Entfaltung der Digitalen Ökonomie gefunden werden. Daraus lassen sich politisch/strategische Optionen für eine österreichische Politik im Rahmen der europäischen Informationsgesellschaft ableiten, die als inhaltliche Grundlage für Maßnahmen in diesem Bereich dienen können.

FDer Übergang zur Informationsgesellschaft, geprägt durch eine Kombination aus Liberalisierung, Globalisierung und technologischem Wandel, führt zu einer Krise der traditionellen staatlichen Steuerung indem er neue Anforderungen an die nationalstaatliche Wirtschafts- und Gesellschaftspolitik stellt. In Reaktion darauf kommt es zu Veränderungen der institutionellen Form (Polity), der politischen Inhalte (Policy) und des prozessualen Ablaufs der Politik (Politics), die als Transformation der Staatlichkeit zusammengefasst werden können. Industrie und Politik - prominent etwa die Europäische Kommission - setzen nun hohe Erwartungen in neue Formen der "Selbst- und Ko-Regulierung", in die stärkere Einbeziehung der Industrie für die Sicherung öffentlicher Interessen. Selbst- und Ko-Regulierung bilden somit einen zentralen Baustein in der neuen Rolle des Staates, bzw. in der transformierten Staatlichkeit. Dies in verschiedenen Wirtschaftssektoren, so auch im konvergenten und globalisierten Mediamatik-Sektor. Die theoretische und empirische Analyse von Selbst- und Ko-Regulierung im Rahmen des Forschungsprojektes umfasst u.a. folgende Fragestellungen:

* Wie lassen sich Selbst- und Ko-Regulierungsmechanismen theoretisch fassen und wie lassen sie sich in der Praxis in den Regulierungsprozess integrieren?
* Welche Vor- und Nachteile ergeben sich?
* Welche Strategien werden in Österreich, von der EU und in ausgewählten Ländern verfolgt?

Rainer Bauböck: Self-government and the Boundaries of Political Community (preliminary title)

This book addresses debates in contemporary political theory on the legitimacy of territorial self-determination, the integration of multinational and supranational federations, and cultural minority rights. The book is not a collection of papers but a monograph. It draws on arguments that I have published in various essays over the last five years, but attempts to develop them in more systematic way. My approach combines normative political theory with a comparative and contextual analysis of institutional arrangements in democratic states.

The basic idea is that ethnonational conflicts are often best understood not as clashes between different cultural identities and values, but as conflicts over the boundaries of political communities. Rather than self-government being only instrumentally important for defending a certain cultural identity or way of life, I think of self-government as intrinsically important and as the core issue in most nationalist conflicts. In my view liberal democratic theory lacks coherent answers to questions about the legitimacy of political boundaries and to demands for their revision. My book tries to close this gap by examining the various contexts in which claims for self-government arise.

In the first part I suggest a conceptual and normative distinction between self-government and self-determination. There can be no universal right of political communities to determine themselves the boundaries of their jurisdiction and the powers of their government. On the one hand, I endorse a grievance approach that regards the territorial stability of borders as an important precondition of democratic government and puts the burden of justification for secession on the shoulders of the secessionist group. On the other hand, I suggest that the essential grievance that may generate a right to secession is a violation of a prior right to self-government. This leads to the conclusion that respect for human rights and equal citizenship under the rule of law is not sufficient to refute a challenge to the territorial integrity of a liberal democratic state. Such states have to recognize a primary right of self-government of historical and geographically concentrated communities living within their territory. This raises the question how to identify these communities and how to assess their claims to autonomy. I criticize liberal nationalist responses on two accounts. First, because they wrongly conceive of self-government only as a means for the preservation of national culture; second, because they wrongly regard self-government as a privilege of nations, which ignores or devalues local, multinational and supranational forms of political community.

In the second part I examine federal arrangements of nested self-government. My general argument is that the different levels of federations should be conceived as distinct forms of self-government, with different constructions of boundaries and rules of membership. Encompassing units do not simply replicate the characteristics of smaller units on a larger scale. I use this idea to examine multinational federalism, non-territorial autonomy and local self-government. First, while multinational federalism accommodates the desire of minority nations for self-government at the provincial level, the larger federation itself should not be constructed as a “nested nation”, but as a pluralistic and composite polity of a different kind. I specifically address the question whether asymmetric arrangements, which appear to privilege national minorities, are unjust and undermine the stability of federal polities. Second, I argue against cultural nationalism that the constitutive units of multinational federations should be generally constructed as territorial jurisdictions rather than as non-territorial cultural communities. Third, local self-government at the municipal level should not be seen as merely a lowest level of subdivision of a national territory, but as creating new spaces for transnational and residence-based membership.

The third part is about transnational and supranational forms of political community. How should liberal democracies change their conceptions of the polity in response to migration, to European integration and to globalization? The first chapter discusses how sending and receiving countries of international migration respond to phenomena of political transnationalism, such as dual nationality, expatriate voting and attempts of extra-territorial nation-building. I then demonstrate that the integration of immigrants undermines traditional conceptions of self-government in clearly bounded and internally homogeneous political communities. I show this by examining arguments for a franchise for non-citizens at the local level and for an inclusive public culture in societies of immigration. Demands for cultural integration on pluralistic terms imply constraints on the cultural self-determination of national majorities with regard to the ways in which their traditions are established and reproduced. Multinational federalism and immigrant multiculturalism both undermine basic assumptions of nationalist ideology. The former challenges the equation between nation and state, the latter the equation between nation and culture. The final chapter considers supranational and global levels of self-government. The point is, once again, to show that the boundaries of political community and conceptions of membership are different from standard models of federalism that have been developed for independent states. This is demonstrated by examining European Union citizenship. The attempt to create a supranational European polity still does not resolve the dilemmas of cosmopolitan democracy. I argue against extending the logic of multilevel government to a global federal polity and for a “cosmopolitanism from below” that makes democratic states more responsive towards the multiple and transnational political identities of their citizens.
