Archive of ECJ Penalization Proceedings

Description:
In some cases, EU Member States will not obey EU rules even after having been condemned by the European Court of Justice (ECJ). Since the Treaty of Maastricht, the Commission has the possibility to seize the ECJ a second time and even call for fines in so-called "Second Proceedings" or "Penalization Proceedings". The first 29 such cases have been reviewed in a project funded by the Oesterreichische Nationalbank (Anniversary Fund, project number 13261). It has covered all proceedings that entered the ECJ´s registry between the Maastricht Treaty´s coming into force on 1 November 1993 and 31 December 2007. This archive makes these case analyses available to the public and also adds later cases, most importantly those with penalization judgments.
